These Terms govern your use of impervora.com and any purchase you make from us. By using this site or placing an order, you agree to them. Please read them carefully.
Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order. By ordering you confirm that the information you provide is accurate and that you are authorized to use the payment method presented.
Products, Descriptions, and Imagery
We describe our products as accurately as we can. Jewelry is photographed under studio lighting and often enlarged to show detail; colour, finish, and scale may vary slightly from what appears on your screen, and screen calibration differs between devices. Natural gemstones vary in colour, clarity, and inclusion by nature — this is a characteristic of natural stone, not a defect.
Stated measurements are nominal and subject to normal manufacturing tolerance. Where a weight or size is given as approximate, it is an approximation.
Pricing and Availability
All prices are in United States Dollars (USD) and exclude shipping and applicable taxes unless stated otherwise. We may change prices and withdraw products at any time without notice; changes do not affect orders already accepted.
Product availability is not guaranteed until your order is accepted. In the rare event that an item is unavailable after you order, we will notify you and refund you in full.
Pricing Errors
Despite our care, an item may occasionally be listed at an incorrect price. Where a price is obviously erroneous, we reserve the right to cancel the order and refund you in full, even after payment has been taken. We will always contact you before cancelling and will offer you the option to proceed at the correct price.
Order Acceptance
Your order is an offer to buy. A confirmation email acknowledges receipt of your order but does not constitute acceptance. The contract between us is formed only when we dispatch your order. We may decline or cancel any order, including where we suspect fraud, where an item is unavailable, or where a pricing error has occurred.
Payment
Payment is taken in full at the time of order. All transactions are processed by a PCI-DSS compliant payment provider over an encrypted connection. See our Payment Methods page for accepted methods.
Shipping and Returns
Delivery is governed by our Shipping Policy and returns by our Return & Refund Policy. Both are incorporated into these Terms by reference. Risk of loss passes to you on delivery to the address you provide.
Intellectual Property
All content on this site — including the IMPERVORA name and marks, text, photography, graphics, and layout — is owned by or licensed to IMPERVORA and protected by intellectual property law. You may not reproduce, distribute, or create derivative works from it without our written permission.
Acceptable Use
You agree not to use this site to break any law, to attempt unauthorized access to our systems or another user’s account, to introduce malicious code, to scrape or harvest data by automated means, or to interfere with the site’s operation.
Third-Party Links
This site links to external destinations, including the IMPERVORA eBay Store. Purchases made on eBay are governed by eBay’s own terms and policies, not these Terms, and are subject to eBay’s buyer protection rather than ours. We are not responsible for the content or practices of third-party sites.
Disclaimer and Limitation of Liability
To the fullest extent permitted by law, this site and its contents are provided “as is” without warranties of any kind, express or implied. Our total liability arising from any order is limited to the amount you paid for that order.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded — including your statutory rights as a consumer, which are not affected by these Terms.
Governing Law
These Terms are governed by the laws of the State of Arizona and the United States, without regard to conflict of law principles. Disputes shall be subject to the courts located in Maricopa County, Arizona. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence.
